I know that the 17th Annual Paint El Paseo Pink event on Saturday, October 14, 2023, is a potentially hazardous activity and I hereby assume full and complete responsibility for any injury, illness (including COVID-19) or accident which may occur during my participation for this community event or while on the premises of this event and its pre-registration events, and I hereby release and hold harmless and covenant not to file suit against Desert Cancer Foundation, the City of Palm Desert, its officers, officials, agents, employees and volunteers, any event sponsors and their agents and employees, and all other persons or entities associated with this event (the Releasees) from any loss, liability or claims I may have arising out of my participation in this event, including personal injury, illness or damage suffered by me or others, whether same be caused by falls, contact with participants, conditions of the community, negligence of the Releasees or otherwise. Participant shall cause all individuals and entities participating in Promotion to hold harmless and release Owner and Taubman Company LLC as Managing Agent from any and all claims and liability growing or arising out of the Promotion or their presence at the Center in connection with the Promotion. I hereby grant permission to Desert Cancer Foundation and its authorized agents to use my name, photographs, videotapes, motion pictures in connection with this event, including recording any other record of my participation in this event for any purpose.
